All Diecast Markets policies

These Marketplace Terms are the contract between you and Diecast Markets Inc. ("Diecast Markets", "we") for use of the Diecast Markets website and marketplace. Version MARKETPLACE_TERMS_2026_10_V6 is effective October 8, 2026. Sellers also agree to the Seller Agreement. The policies linked from these terms are part of them. Where a policy version is recorded on an order, that version governs that order.

1. Who we are

Diecast Markets Inc. operates Diecast Markets. Our mailing address is po box 68642 brampton RPO great lakes, ON, L6R0J8. Legal notices go to legal@diecastmarkets.com. Other contacts are listed at the top of this page and on the Contact page.

2. Eligibility

You may open an account only if you are at least 18 years old, have reached the age of majority required where you live, and can enter a binding contract. You confirm this when you create the account and again if we ask you to re-accept a new version of these terms. We do not ask ordinary buyers for a date of birth to check this point. Checkout ships within Canada, excluding Quebec. Quebec support is planned for a future release. Sellers must be located in Canada, excluding Quebec. Quebec support is planned for a future release. Other countries are not currently enabled. Quebec is not live. Planned markets do not become available merely because a country appears in a phone, address, or waitlist field. See Market Availability & Regional Compliance.

2A. Canada-only availability and mandatory law

Canada excluding Quebec is the current early-access market. Quebec and every country outside Canada remain disabled. Mandatory Canadian federal or provincial consumer, privacy, tax, e-commerce, and marketplace rules take priority over conflicting wording in these terms to the extent the law requires.

3. Your account

Give accurate information and keep it current. Keep your password private and do not share your account. You are responsible for activity under your sign-in until you tell us it has been compromised. Tell us promptly at legal@diecastmarkets.com if you believe someone else is using it. One person, one account, unless support agrees otherwise. Phone verification is required before selling.

4. What Diecast Markets is and is not

Diecast Markets is a marketplace intermediary. We provide listing tools, search, checkout, messaging, dispute handling, and payout tools. When a buyer pays for a listing, the contract of sale for that item is between the buyer and the seller. Diecast Markets is not the seller, does not take title to the item, and is not a party to that sale, unless a listing states that Diecast Markets itself is the seller. We do not inspect items before sale.

5. Listings

Sellers must describe the item accurately, choose the condition honestly, use photos of the actual item, and disclose damage, missing parts, repaints, and repackaging. A seller must accurately state whether they are selling privately or in the course of a business. We may display that status so buyers can understand which mandatory consumer rights may apply. A seller must not misrepresent business or trader status to avoid consumer-law obligations. A custom or modified item must be labelled as such and must not claim manufacturer authorization the seller does not have. Sellers represent that they own the item or have the right to sell it, and that it is not stolen, counterfeit, recalled where sale is unlawful, or otherwise prohibited. The Conduct & Listing Standards and Prohibited & Restricted Items policies apply. We may remove any listing that we reasonably believe breaks these terms or the law.

6. Buying

Before you pay, checkout shows the item, the seller, the item price, any buyer-paid shipping, optional protection charge, tax treatment, total, return terms, and the versions of the policies that will govern the order. You can correct the shipping address and review or decline the transaction before paying. When you tick the acknowledgement and pay, you accept those documents for that purchase. A written copy with the same stored values is emailed to you and kept on your receipt. Where a seller is acting as a business, real-money checkout will not be enabled until the required supplier/business identity and contact disclosure is part of the pre-payment contract flow. Pay only through the marketplace checkout.

7. Prohibited activity

  • Arranging or requesting payment outside the marketplace for a marketplace listing, or moving a marketplace conversation off-platform to avoid fees or protections.
  • Listing or selling counterfeit items presented as genuine, stolen goods, unlawful recalled goods, firearms or ammunition, real-world weapons or explosives, illegal drugs or controlled substances, restricted medication, alcohol, tobacco or vaping products, hazardous materials, explicit sexual content, hate or extremist merchandise, or other items prohibited by the Prohibited & Restricted Items policy.
  • Fraud, fake tracking, false disputes, false reviews, or manipulation of prices or searches.
  • Harassment, threats, or misuse of another person's information.
  • Unauthorized access to accounts, data, or systems; scraping; or interfering with the service.
  • Creating accounts to evade a restriction or suspension.

8. Payments

Buyers pay through Stripe in Canadian dollars. We do not store full card numbers. Real-money checkout remains closed until the Canadian tax, consumer-contract, privacy/CASL, platform reporting, and business-seller disclosure launch controls are completed and approved. Once checkout is opened, an order is marked paid only when Stripe confirms the payment to our server and the amount matches the order. The Payments & Seller Payouts policy explains payment confirmation, refunds, reversals, and chargebacks.

9. Seller payouts and holds

Sellers are paid through Stripe Connect after completing Stripe onboarding. After a sale the payout is held. Current release estimates are 14 days after payment, 7 days after the seller marks the order shipped with tracking, and 3 days after the buyer confirms receipt. A payout stays held or is blocked while the order is unshipped, while a dispute, refund, or chargeback is open, and where a reserve is applied as permitted by the payment provider or the law. A refund after payout may be recovered from the seller.

10. Fees

The standard Diecast Markets platform fee is 4% of the item price. It is deducted from the seller side; the buyer pays the listed price. Stripe payment processing is separate from the Diecast Markets platform fee. This marketplace does not state a Stripe processing percentage. We never present Stripe's charges as part of the 4% fee. If tax becomes chargeable on our fee it will be shown as tax, not hidden inside the fee. Details are in Fees & Taxes.

11. Retired seller subscription

Diecast Markets does not offer a paid seller subscription. Selling uses the 4% platform fee described above, plus separate payment processing. A Pro subscription does not by itself waive the Diecast Markets platform fee. The 4% seller fee applies unless Diecast Markets has explicitly enabled a Pro fee waiver. Stripe payment processing remains separate. A fee already recorded on an order is not rewritten if that rule changes later. If you already have a seller subscription, it is not cancelled by this page. An existing seller subscription, if any, renews automatically until you cancel it in the Stripe billing portal. New seller subscriptions cannot be started. This section is a product change and still needs qualified Canadian legal review before it is treated as the final customer terms.

11A. Collection Tracking Pro

Collection Tracking Pro is a separate monthly subscription for the collection tool. It is not a marketplace seller plan, and buying it does not open marketplace checkout. The price is $7.99 CAD per month plus applicable GST/HST calculated by Stripe Tax from the billing address. The price is tax-exclusive. The subscription renews each month until you cancel. You can cancel in the billing portal, and cancellation takes effect at the end of the period already paid. We do not delete your collection when you cancel. After paid access ends, the free plan limit applies to adding more cars; cars already saved stay in your account.

The subscription is offered to billing addresses in Canada excluding Quebec. It is not offered in Quebec, the United States, or any other country. Saskatchewan and Manitoba are not available until the provincial sales-tax registration required to sell this service there is in place. British Columbia provincial sales tax is not collected by this subscription unless a British Columbia PST registration is later present in Stripe Tax. A charge for an unsupported billing address is cancelled and refunded, and it does not turn on Pro access. Collection Tracking Pro includes $3.00 CAD of AI scanning per billing period. A repeated scan of the same photo uses the saved result and does not spend the allowance. When the allowance is used, adding and editing cars manually still works. AI scanning is not unlimited. Manual collection management does not depend on the AI service. Collection Tracking Pro does not predict future prices and does not guarantee the market value of any collectible.

Before checkout you confirm the monthly renewal, the tax treatment, and the AI allowance. Stripe emails the invoice. Support for this subscription is legal@diecastmarkets.com. This section describes the product that the software implements. It has not been signed off by external counsel, and paid checkout stays off until that review and the tax registrations are accepted.

12. Shipping

Sellers ship directly to buyers with a carrier and tracking number, currently within 3 business days after payment is recorded. If a listing has buyer-paid shipping, that shipping amount is disclosed before payment and included in the Stripe checkout total; otherwise the listing shows free shipping. Automatic labels are not live. See the Shipping Policy.

13. Returns, refunds, disputes, and Buyer Protection

Buyer Protection and Returns & Refunds describe what a buyer can report, the evidence needed, and possible outcomes. A dispute can be opened on the order while its status allows it; the system does not currently reject a dispute only because a stored deadline has passed. Refunds go back to the original payment method through Stripe. A card chargeback is separate from a marketplace dispute; neither replaces the other. You agree to cooperate with a review and to provide truthful evidence. A seller-selected return setting, an As-Is label, or a marketplace policy does not remove a statutory cancellation, refund, repair, replacement, consumer-guarantee, or misrepresentation remedy that applicable law makes mandatory. This is especially relevant where the seller is acting as a business or trader rather than as a private individual.

13A. Condition disclosures and As-Is listings

Sellers must describe item condition truthfully and disclose known material issues. An As-Is listing means the item is offered in the current condition disclosed before checkout; it does not permit concealment or misrepresentation and does not waive a right that applicable law makes non-waivable. Where condition evidence or an As-Is acknowledgement is recorded on an order, that snapshot is retained as transaction evidence.

14. Content, reviews, messages, and moderation

Listing titles, descriptions, and photos may be screened by automated moderation tools before publication and after edits. A listing may be automatically published, rejected, or held for review. Automated checks are an enforcement aid and do not transfer responsibility for the legality or accuracy of a listing away from the seller. A seller may request a manual review of a moderation decision through support.

Marketplace messages and chat images may be automatically screened for harassment, threats, explicit sexual content, prohibited-item transactions, fraud, personal or payment information, and attempts to move a marketplace transaction off-platform. We may block a message or image before delivery, retain a moderation record, and review flagged content for safety, disputes, or enforcement. Casual profanity that is not directed at or used to harm another person is not prohibited solely because it contains profanity.

You keep ownership of the photos and text you submit. You grant Diecast Markets Inc. a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, adapt for display, and distribute that content as needed to operate, promote, back up, and secure the marketplace and to review disputes, for as long as the content is on the marketplace and afterwards as needed for records. You represent that you have the rights to grant this licence. Reviews and messages must be about the transaction and be honest. We may remove or hide content that breaks these terms or the law.

15. Intellectual property

The Diecast Markets name, site design, and software are ours or our licensors'. Genuine diecast items may bear other companies' trademarks; that does not permit counterfeit items, copied photos you have no rights to, or false claims of affiliation or authorization. Rights holders can report infringement under the Intellectual Property Policy. We may remove content while we review a credible claim.

16. Taxes

Sellers are responsible for income tax and for GST/HST or provincial sales tax that applies to their own activities. That does not remove any duty that the law places on Diecast Markets. Diecast Markets may have its own collection, withholding, remittance, or reporting duties, including under Canada's digital platform operator reporting rules where they apply, and may collect seller identity and tax information for that purpose. Sales tax is not calculated at checkout in this version. Nothing in Seller Hub is tax, legal, or accounting advice.

17. Privacy and service providers

Our Privacy Policy explains how we handle personal information. We use service providers including Supabase, Vercel, Stripe, Resend, and Twilio, and Google Analytics only after you consent to analytics. Some providers process information outside Canada. Stallion Express receives only the destination country, postal code and package details a seller enters into the shipping estimator; no shipping-label provider receives buyer names or addresses while label purchasing is off.

18. Suspension, restriction, and termination

You can close your account through the privacy request page. We may restrict, suspend, or close an account, remove listings, or hold payouts when we reasonably believe these terms, a linked policy, or the law has been broken, when required by a payment provider or authority, or to protect users or the service. We will tell you unless the law or a security reason prevents it. Sections that by their nature should survive—such as fees owed, records, licences already granted, disclaimers, limitations, indemnity, and governing law—survive closure. Records needed for tax, accounting, disputes, security, or law are kept as described in the Privacy Policy.

19. Changes to these terms

We may change these terms. A material change gets a new version identifier and effective date, is posted in the Policy Center, and is announced by a service message where the law requires. When acceptance of the new version is needed, we will ask you to accept it before you take a protected action such as listing or checkout. Historical orders keep the versions recorded at checkout.

20. Electronic communications and notices

You agree that we may send service messages about your account, orders, security, and policy changes electronically to the email on your account and through in-app notifications. Optional marketing is separate and needs your consent; see Electronic Communications & Marketing. Legal notices to us go to legal@diecastmarkets.com or by mail to po box 68642 brampton RPO great lakes, ON, L6R0J8.

21. Disclaimers

The marketplace is provided with the care we can reasonably give it and otherwise as available. We do not guarantee that a listing is authentic or accurately described, that a seller will ship, that a buyer will pay, or that the site will be uninterrupted or error-free. To the extent permitted by law we disclaim implied warranties, but nothing in this section removes a warranty, condition, or right that Canadian federal or provincial law does not allow to be excluded.

22. Limitation of liability

To the extent permitted by law, Diecast Markets Inc. is not liable for indirect, incidental, special, or consequential loss, or for loss of profit or data, arising from the marketplace or from a transaction between users. To the extent permitted by law, our total liability to you for claims relating to the marketplace in any twelve-month period is limited to the greater of the Diecast Markets platform fees you paid to us in that period and CAD $100. These limits do not apply to liability that cannot be limited by law, including for our own gross negligence or wilful misconduct where the law prohibits limiting it, or to mandatory consumer rights.

23. Indemnity

To the extent enforceable under the law that applies to you, you will indemnify Diecast Markets Inc. against third-party claims, losses, and reasonable legal costs that arise from your listings, your content, your breach of these terms, or your violation of the law or another person's rights. This does not apply where a claim results from our own breach or fault, and it does not apply where consumer protection law prohibits it.

24. Governing law and mandatory rights

These terms are governed by the laws of Ontario and the federal laws of Canada that apply in Ontario. If you live elsewhere, this choice does not remove a mandatory consumer, privacy, e-commerce, or other protection that applicable law gives you and does not allow you to waive. Courts in Ontario have jurisdiction, subject to any non-waivable right you have to bring a claim or seek a remedy where you live. Nothing in these terms takes away a right that cannot be waived by contract.

25. General

If a clause cannot be enforced, it is limited to the minimum extent needed and the rest of the terms stay in place. Our not enforcing a clause on one occasion is not a waiver. You may not assign these terms without our consent; we may assign them to a successor that takes over the marketplace, with notice. These terms, the Seller Agreement where you sell, and the linked policies are the whole agreement between you and us about the marketplace.
