This policy covers intellectual property on Diecast Markets: what sellers must own or have rights to, what may not be represented, and how a rights holder can report infringement.
Seller content
Sellers must own, or have permission to use, the photos and text in their listings. Take your own photos of the actual item. Do not copy another seller's photos, a manufacturer's catalogue images, or text from another site without the right to do so. By listing, you grant Diecast Markets Inc. the licence described in the Marketplace Terms to display that content on the marketplace.
Trademarks and authenticity
- A genuine diecast car carries its manufacturer's and the vehicle maker's trademarks. Describing a genuine item by its real brand, series, and casting name is permitted.
- No counterfeit representations: an item that is not genuine may not be described, titled, or photographed as genuine, and reproduction packaging may not be passed off as original.
- No trademark confusion: do not use a brand or series name for an item that is not that brand or series, and do not use logos in a way that suggests the listing is the brand owner's.
- No false affiliation or authorization: do not claim to be, or to be authorized by, a manufacturer, licensor, or vehicle maker unless that is true. Custom work must be labelled custom and must not claim manufacturer approval.
Reporting infringement
If you own a copyright, trademark, or other right and believe a listing infringes it, email legal@diecastmarkets.com or write to po box 68642 brampton RPO great lakes, ON, L6R0J8. Include:
- your name, organization, and contact details;
- the URL of each listing you are reporting;
- a description of the work or mark and, where applicable, its registration;
- why the listing infringes (for example counterfeit, copied photo, false authorization);
- a statement that you are the rights holder or authorized to act for them, and that the information in the notice is accurate.
What Diecast Markets does with a notice
Diecast Markets Inc. reviews notices and may remove or hide the listing while a credible claim is reviewed, before a final decision. We tell the seller that a notice was received and may share the notice with them so they can respond. A seller who believes the removal was in error can reply to legal@diecastmarkets.com with their basis. Repeat infringement leads to restriction or closure. This mailbox handles complaints; it is not a court and does not decide legal rights between the parties.
