Diecast Markets ("the Platform", "we", "us") is operated by COLLECTORMARKETS, a sole proprietorship registered in Ontario, Canada under the Ontario Business Registry. By accessing or using diecastmarkets.com, you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.
You must be at least 18 years of age to create an account or complete a transaction on this Platform. By using the Platform you represent that you are 18 or older and have the legal capacity to enter into a binding contract under Ontario law.
Diecast Markets is a marketplace that connects independent buyers and sellers of diecast collectibles. We are not a party to any transaction between buyers and sellers. We do not own, inspect, or guarantee any items listed. All sales are between the buyer and the seller directly. We act solely as a payment escrow and dispute resolution intermediary.
The Platform charges a 12% fee on the final sale price of every completed transaction. This fee is deducted from the seller's payout. There are no listing fees. Payment processing fees (Stripe or PayPal) are separate and deducted before the 88/12 split. The Platform fee is non-refundable once a transaction is completed.
All buyer payments are held in escrow via Stripe or PayPal. Funds are released to the seller automatically 72 hours after confirmed delivery, provided no dispute has been opened. The Platform reserves the right to withhold funds during an active dispute investigation. Payouts are made via the seller's chosen method on file.
The following are strictly prohibited on the Platform: counterfeit or replica items sold as authentic; items that infringe intellectual property rights; off-platform payment solicitation; harassment or abuse of other users; false or misleading listings; circumventing the escrow system. Violations may result in immediate account termination and forfeiture of pending payouts.
Buyers may cancel an order only before the seller generates a shipping label. Once a label is generated, cancellations are not permitted except through the dispute process. Approved refunds are returned to the original payment method within 5–10 business days. Note: payment processing fees paid to Stripe or PayPal are non-recoverable and will be deducted from refunded amounts. The Platform is not liable for Stripe or PayPal processing fees on cancelled orders.
Disputes must be filed within 72 hours of confirmed delivery. The Platform will review tracking information, packing video evidence, and communications to make a determination. The Platform's decision is final. Users agree to cooperate fully with any dispute investigation. Fraudulent dispute claims may result in account suspension and legal action.
To the maximum extent permitted by Ontario law, COLLECTORMARKETS and Diecast Markets shall not be liable for: any indirect, incidental, or consequential damages; loss of profits or revenue; items lost or damaged in transit; actions or omissions of third-party carriers, payment processors, or users. Our total liability to any user for any claim arising from use of the Platform shall not exceed the Platform fees paid by that user in the 30 days preceding the claim.
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario. Users outside Canada consent to this jurisdiction for all platform-related disputes.
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the Platform after changes constitutes acceptance of the revised Terms. For material changes, we will notify registered users by email.

You must be 18 years of age or older to sell on the Platform. By registering as a seller you represent that you have full legal right to sell the items you list, that all items are your own property or you are authorized to sell them, and that you will comply with all applicable Canadian and Ontario laws including consumer protection legislation.
All listings must be accurate and not misleading. You must: accurately describe the item's condition (Mint, Near Mint, Very Good, Good, Loose); disclose all known defects, damage, or card imperfections; use your own photos that genuinely represent the item being sold; set a fair and legal price. Listings for counterfeit, stolen, or misrepresented items are strictly prohibited and will result in immediate account termination and referral to authorities.
Before sealing every shipment, you are required to record a continuous, unedited packing video showing: (a) the item's condition before packing; (b) the item being wrapped and placed in the shipping box; (c) the box being sealed. This video is your sole protection against "not as described" or "damaged in transit" buyer claims. Sellers who cannot produce a packing video will have disputes decided in the buyer's favour by default. The video must be retained for a minimum of 30 days after shipment.
Upon a confirmed sale, you must: ship the item within 3 business days; use a tracked shipping service (Canada Post, USPS, UPS, FedEx, or equivalent); enter the tracking number into the Platform within 24 hours of shipment. Failure to ship within 3 business days without communication to the buyer constitutes a seller cancellation and will count against your seller standing. Repeated shipping delays may result in account suspension.
You agree to pay a 12% platform fee on every completed sale. Your payout of 88% of the sale price (less payment processing fees) will be released automatically 72 hours after the carrier confirms delivery, provided no dispute is open. You are responsible for reporting payout income on your Canadian personal income tax return. The Platform does not withhold taxes on your behalf.
Soliciting buyers to complete transactions outside the Platform — through any channel including messaging, listing descriptions, or external communication — is strictly prohibited. This includes sharing phone numbers, email addresses, social media handles, or external payment links (PayPal.me, Venmo, e-Transfer, etc.) for the purpose of avoiding Platform fees. Violations result in permanent account termination and forfeiture of all pending payouts.
Seller-initiated cancellations (failing to ship after a confirmed sale) are recorded on your seller account. Three or more cancellations within a 12-month period will result in account suspension. Each seller cancellation triggers a full refund to the buyer. Because payment processors (Stripe/PayPal) do not return their processing fees on refunds, a CA$3.00 flat cancellation fee will be deducted from your next payout to recover this cost. This fee applies to every seller-initiated cancellation.
In the event of a buyer dispute, you must respond within 48 hours and provide all requested evidence including your packing video, shipping receipts, and carrier tracking information. Failure to respond to a dispute within 48 hours will result in the dispute being decided in the buyer's favour by default.
The Platform reserves the right to immediately suspend or terminate any seller account for: fraud or misrepresentation; repeated policy violations; chargebacks or payment disputes initiated fraudulently; abusive conduct toward buyers or Platform staff. In cases of fraud, pending payouts may be withheld pending investigation and may be forfeited entirely if fraud is confirmed. The Platform may pursue legal remedies under Ontario law for damages caused by fraudulent sellers.
Sellers are solely responsible for all tax obligations arising from their sales activity on the Platform, including income tax and HST (if applicable). The Platform does not provide tax advice. Once your total annual sales revenue exceeds CA$30,000 you may be required to register for and collect HST under the Excise Tax Act (Canada). Consult a qualified Canadian tax professional.
This Seller Agreement is governed by the laws of Ontario, Canada. Disputes between sellers and the Platform shall be resolved in the courts of Ontario.

When you complete checkout, your payment is immediately collected and held in escrow via Stripe or PayPal. You will receive an order confirmation by email. By submitting payment you are entering into a binding purchase agreement with the seller. The Platform facilitates this transaction but is not the seller.
Your shipping address is locked and confirmed at the time of checkout. The seller ships to exactly the address you provide. The Platform is not responsible for non-delivery or misdelivery resulting from an incorrect address entered at checkout. Address changes after checkout are not permitted once the seller has generated a shipping label. If you need to change your address before a label is generated, contact support@diecastmarkets.com immediately with your order number.
Your payment is protected by escrow. Funds are not released to the seller until: (a) the carrier confirms delivery to your address; and (b) the 72-hour buyer protection window closes without an open dispute. You are protected against: items significantly not as described; items that never arrive (confirmed by carrier). You are not protected against: buyer's remorse or change of mind after shipment; incorrect address entered at checkout; items damaged due to known pre-existing condition accurately disclosed in the listing.
You may cancel your order only before the seller generates a shipping label. To request a cancellation, contact support@diecastmarkets.com immediately with your order number. Once a label is generated, cancellations are not available — you must use the dispute process after delivery. Approved cancellations are refunded to your original payment method within 5–10 business days. Note: payment processing fees charged by Stripe or PayPal are non-refundable and will be deducted from your refund amount.
If your item arrives significantly not as described, or does not arrive, you must file a dispute within 72 hours of the carrier-confirmed delivery date. Disputes filed after 72 hours will not be accepted — funds will have been released to the seller. To file a dispute: log into your account, go to My Purchases, and click "File Dispute." Provide photos and a written description of the issue. The Platform will review all evidence including the seller's packing video and make a binding decision within 3 business days.
The following buyer conduct is strictly prohibited and may result in account termination and legal action: filing fraudulent or bad-faith disputes; initiating chargebacks through your bank or credit card company while a Platform dispute is open (chargeback abuse); soliciting sellers to transact off-platform; harassing or threatening sellers or Platform staff.
If you initiate a chargeback with your bank or credit card issuer while a Platform dispute is open or after a dispute has been resolved in the seller's favour, the Platform reserves the right to: permanently ban your account; pursue recovery of chargeback costs; report the incident to relevant consumer fraud authorities. All chargeback disputes will be contested by the Platform using transaction records, tracking data, and communication logs.
The Platform's determination in any dispute is final and binding. By using the Platform, you agree to accept the Platform's dispute resolution decisions as the exclusive remedy for transaction-related disputes, to the fullest extent permitted by Ontario consumer protection law.
Nothing in this Agreement limits your rights under the Ontario Consumer Protection Act, 2002 or other applicable Canadian consumer protection legislation. If you are a consumer in Ontario, you retain all statutory rights provided by applicable law notwithstanding any term of this Agreement.

This Privacy Policy explains how we collect, use, and protect your personal information in compliance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable Ontario privacy legislation.
Account information: name, email address, password (hashed), country.
Transaction information: shipping address, order history, payment method type (we never store full card numbers — these are handled by Stripe/PayPal).
Seller information: payout method details, listing data.
Usage data: pages visited, browser type, IP address, referral source.
Communications: messages sent through the Platform.
We use your information to: process transactions and facilitate order fulfilment; send order confirmations, shipping updates, and account notifications; resolve disputes; detect and prevent fraud; improve the Platform; comply with legal obligations. We do not sell your personal information to third parties. We do not use your data for advertising purposes.
We share your information only in the following circumstances: With the other party in a transaction — buyers receive seller city/province; sellers receive the buyer's full shipping address after a confirmed sale. With service providers — Stripe (payments), PayPal (payments), Resend (email), Supabase (database), Netlify (hosting), Shippo (shipping labels). All service providers are bound by data processing agreements. Legal requirements — if required by law or valid court order.
Your data is stored on Supabase servers. We use industry-standard encryption (TLS/SSL) for all data in transit. Passwords are hashed and never stored in plain text. Payment card data is never stored on our servers — it is processed directly by Stripe or PayPal. We conduct regular security reviews and apply security patches promptly.
Under PIPEDA, you have the right to: access the personal information we hold about you; correct inaccurate information; withdraw consent for certain uses of your information; request deletion of your account and associated data (subject to legal retention requirements). To exercise these rights, email privacy@diecastmarkets.com. We will respond within 30 days.
We use essential cookies only — for session management and security. We do not use advertising or tracking cookies. We do not use Google Analytics or any third-party ad networks.
We retain account and transaction data for a minimum of 7 years to comply with Canadian tax and business record-keeping requirements. After account deletion, your personal identifiers are anonymized but transaction records are retained in aggregate form for legal compliance.
